Welcome to The Fine Print. The terms “we,” “us,” and “our” refer to The Fine Print. The Fine Print operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with our products and services (the “Services”). The Fine Print is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you have the consent of a parent or legal guardian where applicable.

To use the Services, including browsing our online store or purchasing products or services, you may be asked to provide certain information such as your email address, billing information, payment information, and shipping information. You represent and warrant that all information you provide is accurate, current, and complete.

You are responsible for maintaining the security of your account credentials and for activity conducted through your account. You may not transfer, sell, assign, or license your account to another person without our permission.

SECTION 2 - OUR PRODUCTS AND PRINTED PRODUCTS

We make reasonable efforts to accurately represent our products and services. However, colors, images, materials, finishes, and product appearance may differ from what appears on your device due to screen settings, lighting, materials, printing processes, and other variables.

Printed colors may vary from colors shown on a monitor or mobile device. Unless specifically agreed to in writing, we do not guarantee exact color matching between digital artwork, previous print runs, samples, or finished printed products.

Minor variations may occur in cutting, folding, scoring, mounting, finishing, placement, dimensions, color, and other production characteristics. Such normal production tolerances do not necessarily constitute a defect.

All product descriptions, specifications, pricing, and availability are subject to change without notice. We reserve the right to discontinue any product or service and may limit quantities available to any customer, geographic area, or jurisdiction.

SECTION 3 - CUSTOMER-SUPPLIED ARTWORK AND CONTENT

Customers are responsible for reviewing all artwork, text, spelling, grammar, dates, phone numbers, addresses, dimensions, quantities, colors, and other specifications submitted to us.

We are not responsible for errors contained in customer-supplied artwork, files, instructions, or specifications.

Customers are responsible for submitting files with sufficient resolution and quality for the intended product and size. We may notify you if we identify an obvious issue, but we are not obligated to inspect every file for quality, spelling, grammar, design errors, image resolution, bleed, margins, color mode, or other production concerns.

By submitting artwork, photographs, logos, trademarks, designs, text, or other content to The Fine Print, you represent and warrant that you own the content or have all necessary rights, licenses, and permissions to reproduce it.

You agree that The Fine Print may reproduce customer-supplied content solely as necessary to fulfill your order.

You agree to indemnify and hold The Fine Print harmless from claims arising from allegations that customer-supplied content violates the copyright, trademark, privacy, publicity, or other rights of a third party.

SECTION 4 - PROOFS AND CUSTOMER APPROVAL

When a proof is provided, it is the customer’s responsibility to carefully review the proof before approval.

Approval of a proof authorizes The Fine Print to begin production based on the approved version.

Once a proof has been approved, the customer accepts responsibility for the content shown on the proof, including spelling, grammar, layout, colors, quantities, dimensions, and other details.

The Fine Print is not responsible for errors that were visible on an approved proof.

Changes requested after proof approval may result in additional charges, production delays, or the need to restart production.

SECTION 5 - ORDERS AND CANCELLATIONS

When you place an order, you are making an offer to purchase. The Fine Print reserves the right to accept, decline, modify, or cancel an order for any lawful reason.

Payment may be required before production begins.

Please review your order carefully before submitting it. Because many of our products are custom manufactured or printed specifically for the customer, cancellation may not be possible after production has begun.

If an order is canceled before production begins, we may issue a refund less any design, setup, administrative, material, or other costs already incurred.

Once production has begun, custom orders may be non-cancelable and non-refundable.

If we cancel or materially modify an order, we will attempt to contact you using the email address, billing address, or phone number provided with the order.

Returns, refunds, and replacements are governed by our Refund Policy.

SECTION 6 - CUSTOM PRODUCTS

Many products sold by The Fine Print are made specifically for the customer and may include custom artwork, dimensions, wording, colors, finishes, materials, or other specifications.

Except where otherwise stated in our Refund Policy, custom and personalized products are generally not returnable solely because a customer changes their mind, ordered the wrong item, supplied incorrect information, or approved incorrect artwork.

If The Fine Print produces an order incorrectly compared with the approved artwork or agreed specifications, please contact us promptly so we can review the issue and determine an appropriate resolution.

SECTION 7 - PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice.

The price charged for a product or service will generally be the price in effect at the time the order is submitted or quoted.

Unless otherwise stated, posted prices may not include applicable taxes, shipping, delivery, handling, installation, design work, rush fees, customs charges, or other additional services.

Online pricing may differ from pricing provided through a custom quote, physical location, salesperson, or other sales channel.

You agree to provide accurate and complete billing and payment information and to promptly update that information when necessary.

You represent and warrant that you are authorized to use the payment method provided.

SECTION 8 - SHIPPING, DELIVERY, PICKUP, AND TURNAROUND TIMES

Production, turnaround, pickup, shipping, and delivery dates are estimates unless The Fine Print expressly agrees in writing to a guaranteed deadline.

We are not responsible for delays caused by shipping carriers, weather, natural disasters, equipment failures, material shortages, supply-chain interruptions, incorrect customer information, delayed proof approval, customs processing, or other circumstances outside our reasonable control.

Shipping transit time is separate from production time.

Customers are responsible for providing an accurate delivery address. Additional charges resulting from an incorrect or incomplete address may be the customer’s responsibility.

If a package appears lost, damaged, or delayed, please contact us so we can assist in working with the carrier where appropriate.

SECTION 9 - INTELLECTUAL PROPERTY

Our Services, including trademarks, trade names, logos, graphics, text, product photography, videos, designs, website content, and other materials created or owned by The Fine Print are protected by applicable intellectual property laws.

These Terms permit you to use the Services for lawful purposes related to evaluating and purchasing our products and services.

You may not reproduce, distribute, modify, republish, sell, or commercially exploit content owned by The Fine Print without our prior written permission.

Customer-supplied artwork remains the property of the customer or its respective owner, subject to the limited rights granted to The Fine Print for production and order fulfillment.

Shopify’s name, logo, products, and services are trademarks or intellectual property of Shopify or its affiliates.

SECTION 10 - OPTIONAL TOOLS

We may provide access to third-party tools or services that we do not monitor or control.

You acknowledge that third-party tools may be provided “as is” and “as available,” and your use of such tools is subject to the terms and policies of the applicable third-party provider.

We are not responsible for losses or damages caused by third-party tools or services to the fullest extent permitted by law.

SECTION 11 - THIRD-PARTY LINKS

Our Services may contain links to third-party websites or services.

We are not responsible for the content, accuracy, security, availability, products, services, or policies of third-party websites.

If you access third-party websites or purchase products or services from them, you do so subject to the applicable third party’s terms and policies.

SECTION 12 - RELATIONSHIP WITH SHOPIFY

The Fine Print is powered by Shopify, which enables us to provide the Services to you.

However, purchases made through our store are transactions directly between you and The Fine Print.

By using the Services, you acknowledge that Shopify is not responsible for the products or services purchased from The Fine Print or for disputes arising directly from those transactions, except to the extent otherwise required by law.

SECTION 13 - PRIVACY POLICY

Personal information collected through our Services is subject to our Privacy Policy.

Because our website and ecommerce services are hosted by Shopify, Shopify may collect and process certain information necessary to operate and improve the Services.

Information may also be shared with payment processors, shipping providers, service providers, and other parties where reasonably necessary to process orders and provide Services.

SECTION 14 - FEEDBACK, REVIEWS, AND SUBMISSIONS

If you submit reviews, suggestions, feedback, photographs, testimonials, or other content to us, you represent that you have the necessary rights to provide that content.

Unless otherwise agreed, you grant The Fine Print a non-exclusive, worldwide, royalty-free license to use submitted reviews, testimonials, feedback, and related content for operating, improving, and promoting our business.

You may not submit content that is unlawful, defamatory, fraudulent, infringing, abusive, obscene, malicious, or otherwise violates the rights of another person.

You remain responsible for the content you submit.

SECTION 15 - ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, availability, or other information.

We reserve the right to correct errors, update information, and cancel or modify orders affected by materially inaccurate information to the extent permitted by law.

You may use the Services only for lawful purposes.

You may not use the Services to:

• violate applicable laws or regulations;
• infringe intellectual property or other rights;

• engage in fraud or misrepresentation;

Termination does not affect amounts already owed or provisions that by their nature should continue after termination, including intellectual property, indemnification, limitation of liability, and governing law provisions.

To the fullest extent permitted by law, the Services and products are provided “as is” and “as available,” except for warranties expressly stated by The Fine Print.

We do not guarantee that the website will always be uninterrupted, error-free, secure, or continuously available.

We disclaim implied warranties to the extent permitted by applicable law.

Some jurisdictions do not allow certain warranty exclusions, so these exclusions may not apply to you.

SECTION 19 - LIMITATION OF LIABILITY

To the fullest extent permitted by law, The Fine Print and its owners, employees, contractors, affiliates, service providers, licensors, and agents will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Services or products purchased through the Services.

This includes, where permitted by law, loss of profits, revenue, business opportunities, data, savings, or other consequential losses.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

You agree to indemnify and hold harmless The Fine Print, Shopify, and their respective affiliates, employees, officers, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, and reasonable attorneys’ fees arising from:

1. your breach of these Terms;
2. your violation of applicable law;
3. your infringement of another party’s rights; or
4. customer-supplied artwork or content submitted by you.

SECTION 21 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

SECTION 22 - WAIVER, ENTIRE AGREEMENT, AND ASSIGNMENT

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and other policies posted on our website, constitute the agreement governing your use of the Services.

You may not assign your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations where permitted by law.

SECTION 23 - GOVERNING LAW AND CHANGES TO THESE TERMS

Your continued use of the Services after updated Terms become effective constitutes acceptance of those updated Terms.
